At Kautex, we care about your personal privacy. Because we care, we have adopted the practices described in this Privacy Policy based on the EU General Data Protection Regulation (EU) 2016/679 (hereinafter “GDPR”) and other applicable laws. You should not access the Kautex website (the “Site”) or use our services until you have carefully read this Privacy Policy and agree to the terms and conditions described in it.

Our Collection and Use of Your Personal Information

Personal Data We Collect: The types of information we collect, retain and use include the following:

Site Use Information: In general, you can visit the Site without telling us who you are or revealing any information about yourself. Our web servers collect the domain names, not the email addresses, of visitors.

Registration Information You Provide To Us: When you register on our site to receive news from Kautex, we collect profile information from you ("Personal Data"). We require that you provide the following Personal Data:

  • Your first and last name;
  • Email address;
  • Your company name; and
  • Other information as requested in the applicable registration pages.

At your option, you may voluntarily provide additional information, including address, phone/fax, and, in the case of seeking employment at Kautex, your employment history. Although you may choose not to provide the optional information to us, it may result in some features not being available to you.

How Long We Keep Your Information

 The criteria used to determine the period of storage of Personal Data is the respective statutory retention period. After the expiration of that period, the corresponding data is routinely deleted, as long as it is no longer necessary for business continuity, the fulfillment or initiation of a contract or other valid legal purposes. 

Why We Collect the Information and Your Personal Data

We collect and use information about you which will help us administer and improve our business or provide products, services or other opportunities to you. Among other things, we use the information we learn about you to help us personalize and improve the experience you have on our website.

Site Use Information: This information is aggregated to measure the number of visits, average time spent on the Site, pages viewed, etc. Kautex utilizes this information ("behavior profiles") to measure the use of our Site and to improve the content we offer.
Personal Data: By providing the Personal Data to us, you explicitly agree to our collection and usage of such information as described in this Privacy Policy. We use your Personal Data in the following ways:

To help us determine whether you have received an email from us, and to help us make emails more useful and interesting, we may receive a confirmation that you have opened an email from us. By filling out the various contact forms on our website solely an email is generated to get in contact with you; no further data will be recorded or stored.

Legal Basis For The Processing

Art. 6(1) lit. a GDPR serves as the legal basis for processing operations for which we obtain consent for a specific processing purpose. If the processing of personal data is necessary for the performance of a contract to which you are party, as is the case, for example, when processing operations are necessary for the supply of goods or to provide any other service, the processing is based on Article 6(1) lit. b GDPR. The same applies to such processing operations, which are necessary for carrying out pre-contractual measures, for example in the case of inquiries concerning our products or services. The non-provision of the personal data would entail that the contract with you could not be concluded. Is our company subject to a legal obligation by which processing of personal data is required, such as for the fulfillment of tax obligations, the processing is based on Art. 6(1) lit. c GDPR. In rare cases, the processing of personal data may be necessary to protect your vital interests or of another individual based on Art. 6(1) lit. d GDPR, e.g. if a visitor were injured in our company. Finally, processing operations could be based on Article 6(1) lit. f GDPR. This legal basis is used for processing operations which are not covered by any of the abovementioned legal grounds, if processing is necessary for the purposes of the legitimate interests pursued by our company or by a third party, except where such interests are overridden by your interests or fundamental rights and freedoms, which require protection of personal data. Such processing operations are particularly permissible because they have been specifically mentioned by the European legislator. A legitimate interest could be assumed if you are a client of the controller (Recital 47 Sentence 2 GDPR).

For UK residents - Child Privacy

Because of the nature of our business, our products and services are not designed to appeal to minors, and therefore we do not knowingly attempt to solicit or receive any information from children. Our terms and conditions of use require that any registration may only be made by those aged 18 or older and that any product or service purchases may only be made by those aged 18 or older. If we have reason to believe that information is being provided by a child under the age of 18, Kautex will not collect the information without parental consent or parent notification, which will include the opportunity for the parent to prevent the use of the information or to prevent the child's participation in the activity. Without parental consent, online information will only be used to respond to an unsolicited request and for no other purposes. We recognize that protecting children's identities and privacy online is important and that the responsibility to do so rests with both the online industry and with parents.

Like many websites, we use "cookies" to enable us to remember your password, to help us identify the portions of our Site that may be the most relevant for your needs, and to help us identify other products or services that may be of interest to you or others. When you visit a page of our website that contains such a plugin, your browser establishes a direct connection to the Providers’ servers. The content of the plugin is transmitted by the respective Provider directly to your browser and integrated into the page. By integrating the plugins, the Providers receive the information that your browser has accessed the corresponding page of our website, even if you do not have a profile with the corresponding social network or are currently not logged in. This information (including your IP address) is transmitted by your browser directly to a server of the respective provider in the USA and stored there.

If you are logged in to one of the social networks, the Providers can directly allocate the visit to our website to your profile with the respective Provider. As part of this technical process, the Provider receives information about which specific sub-page of our website you are visiting. This information is collected through the respective Provider’s components and assigned by the Provider to your respective Provider account. If you interact with the plugins, for example by clicking the "Like" button or the "share" button, the corresponding information is also transmitted directly to a server of the Provider and stored there. The information will also be posted on the social network and displayed there to your contacts.

For the purpose and scope of the data collection and the further processing and use of the data by the Providers as well as their rights in this regard and setting options for the protection of your privacy, please refer to the respective privacy policy of the Providers.
 
If you do not want one or more of the Providers to directly associate the data collected through our website with your profile in the respective social network, you must log out of the relevant network before visiting our website. You can also completely prevent the plugins from being loaded with the help of add-ons for your browser, e.g. the Facebook plugins with the "Facebook Blocker".

Creation of logfiles

Each time our website is accessed, our system automatically collects data and information from the computer system of the calling computer. In this case, the following data is collected:

  1. Information about the browser type and version used;
  2. The IP address of the user; and
  3. Date and time of access.

The data is also stored in the log files of our system. A storage of this data together with other personal data of the user does not take place.

The legal basis for the temporary storage of data and log files is Art. 6 para. 1 lit. f GDPR. The temporary storage of the IP address by the system is necessary to allow a secured communication of the website with the computer of the user. Therefore, the user’s IP address must be kept for the duration of the session. Storage in log files is done to ensure the functionality of the website. In addition, the data is used to optimize the website and to ensure the security of our information technology systems. An assessment of the data for marketing purposes does not take place in this context. For these purposes, it is our legitimate interest to process data pursuant to Art. 6 para. 1 lit. f GDPR.

The data is deleted as soon as it is no longer needed for the relevant purpose of processing. In case of the collection of data for the provision of the website, this is the case once the respective session has ended; in case of storing the data in log files, this is after 14 days at the latest. Additional storage is possible. In this case, your IP addresses are deleted or alienated, so that an identification of the calling client is no longer possible.

The collection of data for the provision of the website and the storage of the data in log files is essential for the operation of the website. Thus, there is no possibility for you to object to such a collection.

Restrictions on Disclosing Information to Third Parties

We are not in the business of selling your Personal Data to others.

We maintain numerous security standards and procedures to help prevent unauthorized access to confidential information about you. Our site uses a combination of encryption technologies, digital certificates and authentication to protect your Personal Data. We update and test our security technology on an ongoing basis. When technically feasible, Kautex will - at your request - provide your personal data to you or transmit it directly to another controller.

Reasonable access to your personal data will be provided at no cost upon request made to Kautex at dataprivacy@kautex.textron.com. If access cannot be provided within a reasonable time frame, Kautex will provide you with a date when the information will be provided. If for some reason access is denied, Kautex will provide an explanation as to why access has been denied. In addition, for persons residing in the EU, there is a right to complain to a data protection supervisory authority (Art. 77 GDPR).

In the event of any conflict between the terms of this Privacy Policy and the Terms of Use, then the Terms of Use shall control. As our business changes, this Privacy Policy and the Terms of Use are expected to change from time to time, and we reserve the right to change the Privacy Policy and Terms of Use at any time.
